CartGuard 360° Trial/Test Website

1. Acceptance of Terms

By accessing or using the CartGuard 360° website located at cartguard360.com (the "Site"), registering as a beta tester, joining the waitlist, or submitting any feedback, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

2. Beta Testing Program

CartGuard 360° is currently in a prototype testing phase. Participation in the beta testing program is by invitation only. As a beta tester, you agree to:

Use the prototype product for personal, non-commercial evaluation purposes only.
Provide honest and accurate feedback through the designated survey forms.
Not share, sell, transfer, or distribute the prototype product to any third party.
Not publicly disclose confidential product details, formulations, or proprietary information.
Complete the 7-day check-in and 60-day final review surveys as requested.

3. The Price Challenge

The CartGuard 360° Price Challenge is a voluntary promotional activity offered to beta testers. By participating, you acknowledge and agree to the following:

Participation is free and requires no purchase.
Each tester may submit one price guess in the 7-day check-in and one final guess in the 60-day survey.
The tester whose submitted guess is closest to the official launch retail price will be selected as the winner.
In the event of a tie, the earliest submitted guess will be selected as the winner.
The prize or discount is non-transferable and has no cash value.
CartGuard 360° reserves the right to modify or cancel the Price Challenge at any time without notice.
The winner will be notified via the email address used for registration.

4. Feedback and Intellectual Property

By submitting feedback, survey responses, or suggestions through the Site, you grant CartGuard 360° a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, modify, and incorporate your feedback into our products and services without compensation or attribution to you. You retain ownership of any original content you submit, but you waive any claims related to its use by CartGuard 360° for product development purposes.

5. Prototype Product Disclaimer

The CartGuard 360° product provided to beta testers is a prototype and is not a final commercial product. It is provided "as is" for evaluation purposes only. CartGuard 360° makes no warranties, express or implied, regarding the prototype's performance, safety, or fitness for any particular purpose. Use of the prototype is at your own risk.

6. Privacy

Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your information as described in the Privacy Policy.

7. SMS Communications

SMS Opt-In Terms

Program: CartGuard 360° Waitlist & Prototype Tester SMS Updates

How to opt in: You opt in by providing your mobile phone number on our waitlist form at cartguard360.com and checking the SMS consent checkbox. Providing your phone number without checking the consent box does not constitute opt-in. Opt-in is never a condition of purchase or program participation.

Message types: Waitlist status updates, early access notifications, prototype testing program updates, and product launch announcements.

Frequency: 1–4 messages per month. Frequency may vary.

Rates: Message and data rates may apply.

To opt out: Reply STOP at any time. You will receive one final confirmation and no further messages will be sent.

Help: Reply HELP or email [email protected].

Age: You must be 18 or older to opt in.

Carriers: Available on all major U.S. carriers. Carriers are not liable for delayed or undelivered messages.

No Third-Party Sharing

No mobile phone numbers or SMS opt-in data will be shared with third parties or affiliates for marketing or promotional purposes. Sharing with service subcontractors (e.g., SMS delivery platforms) is permitted solely to deliver messages on our behalf.

All messages will identify the sender as CartGuard 360°. SMS communications are delivered via GoHighLevel / Clear Path CRM on behalf of CartGuard 360°.

8. Limitation of Liability

To the fullest extent permitted by applicable law, CartGuard 360° and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, the beta testing program, or the prototype product. Our total liability to you for any claim shall not exceed the amount paid by you, if any, to participate in the program (which is zero for free beta participants).

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Cherokee County, Georgia.

10. Changes to These Terms

CartGuard 360° reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes your acceptance of the revised Terms.
